1. Agreement to Terms

Welcome to SparkTreasure Social Casino. By accessing or using our platform, you enter into a binding legal agreement with SparkTreasure. These Terms of Service govern your use of all features, games, and content available through our platform. If you disagree with any portion of these terms, you must cease using SparkTreasure immediately.

2. Platform Overview

SparkTreasure provides social casino entertainment through browser-based games. Our service is fundamentally different from real money gambling. All gameplay utilizes virtual credits that possess no real-world monetary value. These credits cannot be converted to cash, cannot be transferred to other platforms, and serve purely as a mechanism for entertainment.

This includes the right to remove games, alter features, change virtual credit systems, or cease operations entirely. We bear no liability for any consequences resulting from service modifications or discontinuation.

9. Disclaimer of Warranties

SparkTreasure provides its services without warranties of any kind, whether express or implied. We specifically disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will meet your expectations, operate without interruption, or be free from errors or security vulnerabilities.

Game outcomes are determined by random number generation and mathematical algorithms. While we strive for fairness, we make no guarantees about specific outcomes, winning frequencies, or entertainment value derived from gameplay.

10. Limitation of Liability

To the maximum extent permitted by law, SparkTreasure and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. This limitation applies regardless of the legal theory underlying any claim and includes damages for loss of data, loss of profits, or loss of entertainment opportunity.

Our total liability for any claims related to SparkTreasure shall not exceed the amount you paid to access the platform, which in all cases is zero since the platform is free.

You agree to defend, indemnify, and hold harmless SparkTreasure and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any laws or third-party rights; or (d) any content you submit to the platform.

12. Dispute Resolution and Governing Law

These Terms shall be governed by applicable laws without regard to conflict of law principles. Any disputes arising from these Terms or your use of SparkTreasure shall be resolved through binding arbitration rather than in court, except where arbitration is prohibited by law.

You waive any right to participate in class action lawsuits or class-wide arbitration against SparkTreasure. All disputes must be brought on an individual basis.

13. Termination

We may terminate or suspend your access to SparkTreasure immediately, without prior notice, for any reason including but not limited to breach of these Terms. Upon termination, all rights granted to you under these Terms cease immediately.

Provisions of these Terms that by their nature should survive termination shall remain in effect, including intellectual property provisions, disclaimers, indemnification obligations, and limitations of liability.

14. Changes to Terms

SparkTreasure reserves the right to modify these Terms at any time. Changes become effective immediately upon posting to the platform. Your continued use of SparkTreasure after changes are posted constitutes acceptance of the modified Terms. We recommend reviewing these Terms periodically to stay informed of updates.

15. Severability and Waiver

If any provision of these Terms is found unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

Failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and SparkTreasure regarding use of the platform. They supersede any prior agreements or understandings, whether written or oral.
